Who would get custody

My brother and his girlfriend split up about 6 months ago since then she has been diagnosed with bi-polar but will not take her medicine and only sees their 1 1/2 yr old son once a week for a couple of hours a week. She is too busy drinking and hanging out with friends. He keeps a record of when she sees him and when she doesn't. Would this type of documentation hold up in court? Does the law favor the mother even if she hardly sees the chid?

Sure, your brother's log would be admissable evidence. The law treats your brother and his former girlfiend equally.
