You need to file a petition to modify with the court that granted your divorce or established paternity. Here is a link to post on my blog about child custody modification: http://haslerlaw2.blogspot.com/2007/02/modifying-decree-custody-modification.html

I seriously suggest you meet with an attorney because custody depends very much on details which e-mail is not very good for getting at.

Re: how to get custody of my child

It is unclear from your posting whether you are divirced from the mother or whether he was born out of wedlock. If out of wedlock and paternity has been legally established, you would petition the court for modification in the best interest of the child.

If you are divorced, you would do the same.

If the paternity has not been legally established, you need to petiution the court to establish paternity, immediate visitation rights and for custody.

Bottom line is that you need to show what is in the best interest of the child in any case.
