custody & child support

16 yr old in girl's school (jail) since Oct. 2000. Still paying mother child support because we cannot afford attorney. Probation officer has cleared us to place the child with us when she is released in April, 2001.

Can we get a form to change custody & drop child support if custodial mother is agreeable?

I'm an attorney in Indiana and will try to answer your questions.

You need to ask the court for a modification of child support hearing. You don't have to have an attorney for this, though it would be helpful.

Basically you would then have an opportunity to tell the court the facts, and from what you've told me, it sounds like the court would go ahead and modify the order.

But you can't just stop paying on your own because then you could end up with a child support arrearage that you'd be liable for.
