Legal Question in Family Law in Indiana

I had custody of my daughter in 2006. I was arrested and incarcerated for 4 years...My ex husband filed Emergency Custody paperwork at that point...I recievied a copy....It said at that time that for permanate custody or to establish child support further court documents would be required...He never filed anything....Now I am out and she wants to come live ith me....she is 17...do I automatically get custody back or do I have to file other paperwork?
