Custody while in jail

I am facing up to 6 years (most likely it will be 6 months) in prison for a class C felony and I need to know what will happen to my four year old son. I am not married and his father and I were never married. I want my mother to have temporary custody of him, but I need to know if the court will fight that decision.

Without knowing more facts, I can only give you a general answer. Indiana law does recognize that a third party can have cusotdy of a child over a parent. The basis of any decision is what the court determines to be in the best interet of the child.
