custody modification

Would the mental and physical health of one parent, failing school grades, the unwillingness to work with the other parent and the refusal to pay support be grounds for custody modification? I filed in 2006 and still have not had a court date that does not get postponed or vacated. The situation just keeps getting worse. Also why would a court allow so many postponments.

The factors that you mentioned would be factors that a court takes into account for mosification. Only your lawyer would be able to explain why there have been so many postponments. If you do not have a lawyer, you should hire one immediately.
