custody

my oldest daughterwill be 16 in jan. she wants to live with me her mother has full custody, is their an age in which she can say who she wants to live with without having to go through a long expensive custody battle?

Re: custody

By law the judge has to give more weight to the desires of a child 14 or older; however, the child does not have the ultimate say-so on his or her residence until 18. Just because the child wants to move in with the non-custodial parent when he or she is over 14 does not mean that there will not be an expensive and protracted custody battle. The judge still has to determine what is in the child's best interests.
