Custody of 14 yr old son
My ex is taking me back to court to try to get custody of our 14 yr. old son. We got into an arguement back in July over chores. My ex took our son with him that day and he hasn't lived with me since. He hasn't lived with my ex either. Our son wants to live with my ex's parents in a small town where he can run around and get into trouble. I live with my parents in the country. Can my ex really try to take custody of our son and then let him live with the paternal grandparents? If he was going to live with him I would say that would be ok, but he lives in a town 20 miles away with his girlfriend. My ex doesn't want our son to live there or with me and my parents. We have another son who is only 6 yrs. old. Now my ex is saying he will get custody of him also. Do you think a judge would agree to that? We have had joint custody with me as the primary parent. Do you think I have any chance without a lawyer? My lawyer dropped me because I can't pay. My ex is $6,000.00 behind in support. What should I do? I think this is all about the money. The prosecutor is taking my ex to court for support on Dec. 22, 2008 and my ex is taking me to court for custody in Jan. 8, 2009. My ex-lawyer tried to work things out but nothing was enough for him

Your ex has every right to try and modify custody, that does not mean that the court will agree. I suggest that you read Indiana Code 31 concerning custody and modification since you can not afford an attorney.
