Legal Question in Family Law in Indiana
My daughter and her husband have been separated for almost 2 years. She just recently filed and won a sexual harassment lawsuit and was awarded money from her place of employment. He told her that she owed "him" all or some of that money. She is spending money on both of their children and is going to put money in her youngest daughters savings account. The youngest lives with dad by choice and the oldest lives with mom by choice. Does she owe "him" any of that money?
1 Answer from Attorneys
If by "separated" you mean that a dissolution of marriage action is pending, then she needs to consult with her attorney. He may have an interest in it, which doesn't mean that she should just give him money right now. If you just mean that they are not living together, she needs to see a family law attorney as soon as possible. The ultimate answer depends on what she is receiving the money for as to her specific damages.
