Legal Question in Family Law in Indiana

My daughter who is 19 lives in Indiana with my 7 month old grandson, she wants to move to Florida with me, can she move here with no problems with the babys father? They are not married he pays no child support his name is however, on the birth certificate. We have all intensions of working out visitations but he is threatning her saying he will take the baby. Please let me know where we stand on this.

If the father did not sign a paternity affidavit or have paternity established in court, your daughter can move at this time. the brith certificate, by itself, means nothing as far as custody is concerned. If he should then seek to establish paternity, a court will determine custody. If he should be granted custody, then he can take the child subject to your daughter's parenting time rights.
