Legal Question in Family Law in Indiana
My daughter's mother is seeking to have me stripped of my parental rights so her ex-husband can adopt my child. She is presently married to another man. However, she has a daughter with her ex-husband and he always included my daughter with his daughter's activities. I have had limited contact with my daughter due to the strained relationship I have with her mother. My child support is current and paid on time.
Is it possible for my parental rights to be stripped and her ex-husband adopt my daughter? This seems ridiculous to me. I have no intention of letting him adopt my child. Here are some additional details: My daughter (13) resides in Indiana with her mother, the ex-husband resides in Illinois, the child support case is in Illinois, and I reside in NC.
Answer
You need to define what is meant by limited. Please post additional facts in LawGuru . How often have you seen her over the years? When was the last time? How often is other communication, what other kinds of communication has there been?
Follow up:
I have seen my daughter approximately once every 2 years. The phone calls are minimal at 5 per year. I used to email my daughter but her mother stopped that. My daughter had a cell phone and we would communicate but that stopped also. I guess her mom took it. I sent a letter on her birthday and her mother said she would not give it to my daughter. I realize my contact has been limited for a number of reasons. However, does that warrant my parental rights being stripped?
How can an ex-husband just adopt my child?

He certainly has the right to petition for adoption. However, he must provide notice to you and you can contest the adoption. You do need to hire counse, though. This is not the kind of case that you should try to handle yourself-too much is at stake.
