Can my wife sue the State for failing to enforce Father to pay his child support

The state of Indiana has no obligation to compel payment of child support by an obligor absent the entitled parent signing up for the support enforcement program or there being a request for assistance forwarded from another state (called an URESA). If your wife contracted with the state of Indiana for child support enforcement and the obligor resides in Indiana and has employment whereby he received a pay check, then it is likely that she could bring an action for failure to enforce. If the obligor has merely moved to Indiana and there is a decree in another state, it is unlikely that she could sue.
