after death custody

my husband and I adopted our grandaughter when she was 2 years old. In the event of our death she is to go to our son Joseph. Everyone has agreed to this. Her biological mother (our daughter) was recently released from jail and grandaughter is afraid that if something happens to us her mother will fight for her and she does not want to go with her biological mother. She wants to go to her uncle and his wife. Can i just have a paper notarized and given to my son?

Unfortunately, you can not just have a paper notarized. However, you can draft a will that indicates your preference for your son to become the guardian of your grandchild/daughter. The courts will usually defer to a parent's wishes as set forth in a will. Good luck.
