Diaries admissible in court?
I was able to get access to my ex-husband's person journals on a laptop that he left here at the house. Many entries have much to do with his feelings of the children and myself, planning the divorce in advance so that he would come out on top financially.
My attorney is trying to use these as evidence in the custody portion of my divorce. His attorney is claiming this is ''privileged private information''. Will the courts allow this information to be used?

This is an evolving area of the law with regard to his private personal, journal entries left on a a computer. However, if they were communication for his attorney in anticipation of litigation, there is a pretty good chance that you will not be able to use them. Since you have an attorney with full knowledge of all of the facts of your case, you would be better served talking to that attorney then asking a question to people unfamiliar with your case on this BBS.
