The answer is night and day. A living trust is an estate planning document that can be used by single, divorced, widowed and married people and deals with an entire estate when a person is alive as well as dead. A prenuptial document, althought in a sense is an estate documents is used more for protecting assets from a new spouse to be in the event of a divorce. However, it can be used as a way of creating a waiver of a spouses right to a statutory share of a probate estate.
