Divorce and child custody/visitation

My sister lives 5 hrs. from home. She is in the process of getting a divorce. She would like to move back home to be near the family. She has no one there to help her out with her single mom status. Can she move back home even though her soon to be ex husband does not want her to? And, how would that work with custody/visitation? He's an alcoholic who has been physically and mentally abusive. He is also addicted to porn.

Due to the complexities of her case, the potential move and the alcoholism, addiction to porn and abusive behavior, your sister should see an attorney as soon as possible. This forum or self help blogs or web sites will not be of much assistance to her. Most attorneys will provide a free initial consultation. She should ask for one.

You call her husband, soon to be ex. I assume that means a divorce has been filed. She can move any time she wants without any restriction before the divorce is filed but after a divorce is filed a statute applies. If she has filed for divorce, she needs to have an attorney and if she does have an attorney then the attorney should be telling her these things.
