Legal Question in Family Law in Indiana

Divorce

I have been trying to get divorced since 11/07. My estranged husband has been unemployed since then but was receiving a severence package until 5/08 in which he paid his $600/mo child support. Now that he is on unemployment, I get child support now and then. My attorney does not want to go to the final hearing until he has a job. Is this really going to matter that much? My legal fees are racking up and I have no ''extra'' income so should I cut my losses and hope the judge is reasonable. Is there any recourse after the final hearing to take him back to court once he gets a job?

Yes. You can file a Petition to Modify if there is a substantial and continuing change in circumstances, in other words, his obtaining permanent employment.
