Divorce Filing Date

My wife filed a petition for divorce in 2004. We reconciled and have been live together of the past 3 years. We have decided now to divorce and the orignal petition is still open in the Courts. She wants to use this date. I do not for property valuation purposes. Since we reconciled for three years, can she still use this date?

If the case is pending, it should still be used. You might try filing a counterpetition and setting forth the dates of reconsiliation and the "final separation" date. Good luck.
