Legal Question in Family Law in Indiana

Does a Divorce Filing Expire?

I was served divorce papers on April 29, 2002. Do these expire after a certain time? My husband is now dragging his feet and thinking about not getting the divorce now. I have since seen an attorney to look over a settlement agreement which I have signed and dated. Will these expire and we will have to file all over again?

Re: Does a Divorce Filing Expire?

If no one does anything for a YEAR after filing, then the court may dismiss the petition.

The court will not divorce you unless you have EITHER a final hearing or submit a signed settlement agreement.

The passage of time alone won't make the divorce happen.

Hope this information helps you.
