Divorce when you have no idea of whereabouts for 13 yrs.
I need to divorce from a marriage that is prohibited. was married nov.5 1990. Spouse in question filed for divorce from previous marriage dec. 21 1990. Also i have not had contact with, or knowlege of whereabouts of person in question for more than 13 yrs. This obviously presents a problem with notification of filing to respondent. Is summary dissolution possible and if so what motins must be filed or how much would it cost me to have it handled professionally? thank you all for your time!

No matter what grounds you allege, you need to follow the dissolution procedure. You cannot use the summary provisions (where you don't go to court) unless you actually locate the other spouse and get the necessary signature on the waiver of hearing. Publication cost is between $60 and $100 to give notice. You wait 60 days and have a 15 minute hearing and are divorced. Different attorneys will charge different amounts. The filing fee is $131 currently in Marion County.
