Legal Question in Family Law in Indiana
Divorce - Indiana
Seperated from alchoholic husband for 3 years now. Have 14 month old daughter that is not his child. He had vasectomy 15 yrs ago. Unfortunately, I do not know who the father of my child is because of bad choices in behavior I made back then. I have since changed and have my life in order now thanks to God and good caring supportive parents. We live with my parents. I don't want anything from my husband but a divorce. He does not know about my child and I am hopeing he does not have to. I do not call him but he will make a rare call to me once every other month or so. He skips from job to job unable to keep his temper in check. He lost a job at the post office after 24 years of working their due to drinking and falsifying his time card. Now he never keeps a job long. I just want a divorce from him and want him to be held free of responsibilty for my daughter. I hope he never has to know about her. How do I start and what can I expect from Indiana law?
Sincere Thanks, Heather

Re: Divorce - Indiana
Unfortunately, Indiana law has a presumption that any child born when two people are married is a child of that marriage. You can rebut that presumption, however, you will have to disclose that the child exists.
Re: Divorce - Indiana
The child is not of any importance to getting a divorce or will have any part to play in the divorce.
