I have til today to file an appeal on a child modification trial. My attorney hasn't returned any calls, text messages, or e-mails for two weeks. He hasn't even notified me that the judge actually ruled on the ''motion of errors'' we filed after the court ruling. I went to the court house and got it myself. My question is: What do I need to file to dismiss him from respresenting me? Do I file a Notice Dismissal of Attorney, or do I file a Substitution of Attorney? I am going to try and handle it Pro Se.

Send him a certifed letter of discharge and ask for a complete copy of your file. Please note that under Indiana Law, he can retain the file if you have not paid your bill in full. He should then file a Motion to Withdraw after receiving your letter
