Legal Question in Family Law in Indiana
My divorce settlement states that both my ex-husband and I will obtain personal loans to cover our own portions of our consolidated student loan debt. I obtained a loan to cover this and he tried, but couldn't. I am worried because if he defaults on the loan, my name is still on it. My lawyer didn't think there was anything I could do because he did TRY to get a loan... I'm wondering if I can take him to court to get insurance or something on his debt that my name is still on.

Your lawyer is right. However, you should find out why he failed to get the loan and see if there is a way to cure the problem. Perhaps a co-signer or guarantor.
