Legal Question in Family Law in Indiana
My divorce was in 04. We have two teens and agreed to 50/50 custody. I agreed to pay $60/wk. The income difference between us is about 10K/yr. In 06, my ex got into it with my son and ordered him out. He has lived with me full time since then. I stopped paying her as the custodial situation changed. She verbally agreed. Since then, I have paid over $35K for both kids cells, both cars, insurance, all my sons college tuition and orthodontal. She has paid virtually nothing. Now she has filed that I am in arrears since 06.
I know I should have had this changed then, but I really didnt expect the estrangement between my son and his mother to be permanent.
Will I be screwed and have to pay her the last 4 years even though the custodial situation changed or will this be considered by the judge?
