divorce/custody

our child was born prior to our marriage, paternity was est. and custody was determined as i was sole custodian, since this happened before our marriage, does it need to be addressed in divorce or can the same rulling stand?

That may be the best question that I have seen on here in over a year. I dont have an answer. However, if custody will be by an agreement, there is no reason why the prior order could not be affirmed by you and your ex to be in the dissolution case with court approval. If the custody is not by agreement, you might be able to agree that the matter will be heard by the judge hearing the divorce. This would save you both time and money. I will tell you that if I was representing your ex to be and there was no agreement, I would ask that the custudy and support issue be transferred to the divorce court.
