Legal Question in Family Law in Indiana

I am divorced with a 17 year old daughter. We had joint custody until he moved to Denver. He does not want to help with college. If I take him back to court is there a change he could be ordered to pay a third? Also he has never paid support through the court. He has sent money that he called support but not the amount that was ordered by the court can I get that paid towards college?

Hello:

You can petition the court for contribution towards college expenses and you should do so as soon as she is admitted to college. Additionally, child support can be used as you see fit for the benefit of the child. If he did not pay all that he is supposed to, you can seek a contempt order against him for arrears. Also, some courts view payments not made through the clerk as gifts,so depedning on all of the circumstances, the court may determine that no support has ever been paid. This is somewhat complex, so I suggest that you contact a lawyer, locally.
