Legal Question in Family Law in Indiana
I am divorced and have a 14yr old daughter, she has visitation with her father when he decides to, last over night visit was July 11. He lives with a lady 2 1/2 hrs away and our daughter does not want to stay there overnight, does she have the right to decide not to stay? She wants to visit her dad just not there.I have been told that our child cant refuse visitation which she doesnt, but if the child isnt comfortable where she is at he has to stay someplace where she is comfortable.

This is something that you need to perhaps discuss with your ex. The court generally does not allow a child to determine the parameters of parenting time. You need to find out why she is uncomfortable, what is it that causes the uncomfort level and then see if it can be corrected. If not, counseling might be in order.
