Legal Question in Family Law in Indiana

elder care - termination of guardianship

My Aunt obtained a temporary guardianship order (60 days) over my Grandmother October 3, 2006 in Indiana. My Aunt has not pursued permanent guardianship because my Grandmother's doctor has found nodules in her right lung that may be cancer and my Grandmother wishes to relocate to Las Vegas to live near me. I was told that I may need to submit a petition for termination of this temporary guardianship. Do I have to do this before relocating my Grandmother here? Can my Aunt resign the guardianship? Or has the temporary simply expired? Thank you for your help....

Re: elder care - termination of guardianship

It it really is a temporary guardianship it expires within 60 days. However, it is best to submit an order reflecting that the guardianship was temporary and that no petition for a permanent one is pending, or if one is pending, that it has been withdrawn and that the temporary guardianship has expired.

It really depends on whether the order setting up the guardianship gave a time limit or not. If not, then a petition needs to be filed.
