Legal Question in Family Law in Indiana

Establishing Praternal Rights

My 20 year old son has a 1 year old son of his own, and wants to establish praternal rights, but is unable to pay the Lawyer fee-court cost etc,. Is there any kind of program available to assist him? When his son was born he signed an avidata, waiving all rights to blood tests, and stated he was the Father. He does not require a blood test for proof, and he wants very much to be able in the future to claim full custody of his son, but he is unable to get pass the first step, because of financial reasons. I would appreciate any information you can provide.

Re: Establishing Praternal Rights

If the mother has not gone to the local prosecuting attorney's child support division, your son can approach them to represent him - however, that office will only seek to establish support and will not represent a party in obtaining custody. Call your local bar association for a pro bono referral or contact your local Legal Aid or Legal Services office for assistance.
