Can we be evicted from the marital home
Husband wants divorce. He has left family home and moved in with his mother (next door). I live in the marital home with my sons (from previous marriage). Husband says I have 15 days to evacuate the family home. Says he has a court order which will force us to leave the home. He has left us with no money ... I have not worked outside the home for 6 years. I am not abusive or threatening in any way. Can we simply be evicted from our home with no where to go? I have been left with virtually nothing -- no way I can afford these mortgage payments. Would you be willing to represent me and how much money do I need to speak with you. Your husband needs to file for a dissolution of marriage and have a preliminary hearing for a judge to determine which of you (husband or wife) gets to remain in the marital residence during the pendency of the dissolution proceeding and which of you is responsible for payment of the mortgage and utilities. If you have not been working and have no source of income, he will likely be ordered to pay you maintenance, as well as paying for the house while you reside there.
