Legal Question in Family Law in Indiana

Falsely accused of abusing daughter

My ex-wife has falsely accused me of abusing my daughter twice. Recently when a medical doctor would not agree to her claims, she took my 3 yr old to the police department where they showed her drawings and asked questions and found no basis for the claims.

The frist time, the same thing. She also contacted CPS about my dog ''mauling'' her, but of course, no medical findings. How many times can she accuse me of this? CPS said that they can ''choose'' to prosecute her if she makes 3 false claims, herself. So, why are they not prosecuting her? Can I take her to court? How can I get my kids away from this dangerous woman? My 12 yr old will not speak to me, when I'm around my 6 year old she will scream ''you touched my butt'' and now my 3 yr old gets on the phone and says ''I hate daddy'' My attorney is a moron, but It seems to be the norm in this backwoods town. The judge does business with my ex-wifes father and will not help me. I'm desperate for someone to help.

Re: Falsely accused of abusing daughter

you may be able to sue her outside the divorce action. You may also be bale to obtain custody on the theory of parental alienation syndrome. Expect to be paying well into the five figures

in order to litigate this matter and possibly obtain custody of the kids.

Good luck
