Father wants to quit job, so he dont have to pay support

My nephew was just ordered to pay support for his new baby, he and mother were never married. Now he says he cant pay the ordered amount so he wants to quit job, and find one that dont pay as much! I am wanting to know what will happen to him and if this is something that can be prevented. What are his choices? We dont agree with him on this issue, He should pay!!!! We also want to be in this babys life, do we have rights as Great Aunt and Uncle?

A parent who quits a job in order to earn less money just to avoid the payment of child support will find that the Court has no sympathy with him and will impute his income at his higher earning power. A great aunt and uncle have no specific rights other than those the particular parents of a child allot to them. Hence, if nephew exercises visitation and shares his time with you and later stops doing that, there is no remedy for you. If mother of child is willing to allow you to spend time with child during her parenting time, she can stop at any time and you have no remedy. Your nephew would be best off learning to rebudget to accomodate his support order. Supporting his child is more important legally than continuing the life style he has developed for himself.
