Father wanting custody after no contact for 5 yrs

My daughter has raised my granddaughter since birth, the father has never been around. He moved back to WV shortly after the child was born and would not even sign birth certificate. Now she received papers for paternity and wanting custody of said child. She has another daughter that after being born (another father) and suffering from post-pardom was tricked into signing power of attorney for child over to an aunt. She is due to have a third child in February yet by another man. She is concerned that this father of the first child will end up with custody. I told her that I did not think a judge would grant this due to the father not haveing contact since birth. What advice can you give me to tell my daughter?

The court will make a determination based upon what is in the best interest of the child. One factor will be the lack of contact between the father and the child.

Your daughter should get an attorney to assist her.
