fathers right to custody

My son is not married to his children' mother but is listed as their father on BC. He has always lived with them problems in relationship now mother on drugs. Can he take the children without legal reprocussion until custody is determined by courts. They children are 9,7 & 2. I want to bring them into my home til things are fixed. Help! My grandchildren are begging me to take them home with me.

Based on the information provided to me, your son needs to establich paternity as having his name on the birth certificate is not sufficient.

He should see an attorney as soon as possible.

Your son needs to immediately find a lawyer in his area who will take the matter into the court. There, custody will be determined as well as paternity. It is not something he should try and do himself.
