Legal Question in Family Law in Indiana
My fiancee and I are having troubles with her ex husband. he is the biological father of ONE of her three children. However, when they were married he signed birth certificates of the other two children. She is unsure whether or not he signed paternity affidavits on them or not, but I am inclined to say probably not, because I think that has to be done within 72 hrs of birth of the child in Indiana, but i may be mistaken. When they divorced the Judge ruled he was bound as legal father to the children and was ordered to pay child support on all three children. He moved to Florida and refuses contact with the other two children and now is stating that he has been in contact with the Child Support Enforcement in Florida. He says they told him the county clerk's office made a mistake in Indiana and he wasn't made aware of the hearing. he lost by default because he didn't show up. He says they told him he can get a paternity test, prove the other children are not his and that he will be able to stop paying child support and that my fiancee will be ordered to repay him all of the child support he has paid in.
