Legal Question in Family Law in Indiana
My Fiance's Sister Will Not Let Her Have Anything to do with Her Daughter, She o
To whom it may concern:
A year or two back my fiance was in jail and gave her sister temporary Guardianship of her 3yr old daughter. She did this because she thought she would be going away for a year or two. Well, she was released about 2 months later and ever since, her sister only lets her see her daughter if she drops by unannounced. She will not let her come home with her, and they hide her with one of her in-laws if they know we're coming. I wanted to know if she can legally do this, and what can we do about it? We have a very limited budget, and it seems that we have no options. I love my fiance, and I hate seeing her hurt like this. Can you please inform me, and point me any directions? Any information or direction, is greatly appreciated. Thank you for your time.
Sincerely,
Delphi, In.

You must petition the court where the guardianship was established to have the judge terminate it or set up a visitation plan that works toward termination of the guardianship. If you cannot afford a lawyer to assist you, go to your local bar association for a pro bono referral or at least write the judge of the court a letter requesting that the child be returned to the mother or that there be regular visitation.
