Can you file for paternity if the child has moved out of state?

My boyfriends son was born in Texas, but his mother moved him to Indianapolis when he was a year old. Paternity was never filed and now he has found out that her husband now has his name on the birth certificate. My boyfriend want to file paternity, but doesn't know if he should file it here in Texas of if he should file it in Indianapolis. Also how could she have put the other guys name on the birth certificate if he wasn't named as the father by the courts????

Talk to a lawyer about issues of child support and visitation and the best interest of the child and what he really wants and expects. Talk to a minister as well.
