Legal Question in Family Law in Indiana

Filing an extension to pay support

My husband and his ex-wife filed a joint modification regarding child

support. The agreement noted my husband had until June 1, 2004 to pay

back support ($2,000). The signed the agreement, but we owed more in

taxes than we anticipaed. Is it possible to get a 30-day extension to pay

the back support?

Re: Filing an extension to pay support

In such a situation, the first person to ask for an extension is the former spouse to whom the money is owed. The next is the prosecutor who represented her. Finally, a petition to the Court which approved the agreement with reasons for why the money cannot be paid timely might be required and that court will hold a hearing.
