financial guardianship
I need to obtain financial guardianship of a minor. Although we have legally adopted her, the state of California says that we must be financial guardians as well. Please tell me how to do this, as we are needing these funds to pay for the funeral of the child's mother. She is biologically our niece, but we adopted her, and it was official in 12/06. According to records, her mother had a small insurance policy through her former employer, and they refuse to pay out until we are financial guardians -- they do not recognize adoption as sufficient. Please help, as my disabled father is on the verge of being sued by funeral company over unpaid funeral service.

You need to petition the court for guardianship of the person and estate of your adopted daughter. Our local courthouse might have fillin the blank forms.

This one is a bit difficult to answer with the facts you have given me. It appears that the California insurance company wants the equivalent of what we call a guardianship over the estate. You need to see an attorney.
As for the funeral home, call them and explain what is going on. They need to know what is going on. They will be less likely to be pushy about the bill if they know you are working on getting a guardianship.
