Legal Question in Family Law in Indiana

A friend of mine is going through a divorce right now. He is trying to get custody of his daughter. He has his wife on tape admitting to doing vicoden, 4 a day everyday. She is also on the tape admitting to smoking weed. Will this tape hold up evidence in his favor in a court of law?

If he was part of the conversation with the wife where she said these things, than it is admissible. If he taped her secretly, he may have broken the law. If by "hold up", you mean to ask whether the court will believe she did these things, than probably yes. If by "hold up" you mean will your friend obtain custody no matter what given this eveidence, than no, it is simply part of all the evidence that the court will weigh. Your friend's attorney is the best source of an opinion on his chances.
