my daughter had a child out of wed lock,never married.C.P.S got invovled.The child became a ward of the state,but the''father'' has custody(she is living in his home) my daughter has mental issues to work out(post partum depr.,post tramatic stress disorder from him abusing her, and drug problems) she wants meand my husband(we are her mom and dad) to have her rights until she can get treatment,so the father does not have total say over the childs life. How do we go about getting this done.

I do not believe that you can have her rights. However, you may be entitled to grandparents rights.

If you can work it out without court intervention, that would be best for all. You should contact the case worker for C.P.S to see if this can be handled informally. If not, then you will need to petition the court.
