Legal Question in Family Law in Indiana

My girlfriend is pregnant, but she's married. Her husband has been in prison for two years, so there's no way it's a child of the marriage. Will I still be able to sign the birth certificate and have rights to my child?

This is an example of why she needed to get done with the marriage before starting a new family. You will have to file a paternity action to establish that he is not the father and you are, because they are still married. You need to sit down with an attorney and take the necessary steps, and not just rely on trying to sign a birth certificate.
