Legal Question in Family Law in Indiana

Do I have to give him visitations?

My ex-husband is being charged with 12 counts of child explotation. Do I have to give him visitaion to my 8 year old son? I do not believe my ex would do my any harm and I am not sure he guilty of the charges, just unluckly downloading adult porn. I dont want my son there until my ex has been cleared. Court order visitation is every other weekend and Tues. and Thurs.

I'd suggest you err on side of caution. Technically speaking, you do not have the right to alter a Court's Order. However, where you feel your child is in danger, you certainly can deny visitation for a reasonable length of time. But if you do that, make sure you follow up with an emergency petition to the Court to modify the visitation order so as to be one of supervised visitation.
