Our grandchildren have lived with us since the middle of December, 2011. Our ex son-in-law has custody. the grandchildren do not want to live with him and want to live with us. Our granddaughter has seen him smoking marijuana and our grandson takes his rolled up bills from his stash in his shed. I am afraid that he will get wasted and hurt the kids. I do know that he has came over several times and to pick the kids up while drinking and driving.

You should hire counsel and seek custody. Based on the information provided, you are considered to be a "deaf to custodian" and have the right to an order of custody. Good luck.
He meant "de facto custodian", but otherwise his advice is right on target. Also, do not ever let someone drive with the children while drunk. Call the cops if you have to, but don't do it.
