grandparental rights

do i have any rights to visitation for my 2 year old granddaughter, whom i believe is living in harms way of her mother, who is not fit to provide a home , medical or proper nutrition for her. her father my son lives in another state and by court agreement does have visitation until may 2009. but pays weekly support. the mother tells us it is only a privilege for us to see her that we have no rights to her. is this true or do we have rights? and if we do, what can we do to get her on a regular basis without a fight from the mother.

You have the right to petition the court for visitation, regardless of the mother's fitness. The court will make a determination as to whether the visitation would be in the best interest of the child. Many factors go into making that determination. There is no method to get this "without a fight" if the mother objects.
