Legal Question in Family Law in Indiana

grandson living at my home

my grandson has been living with me since Dec. 2008 and wants to continue, I do not have written permission for him to live here, his mother does not want to do this because she is afraid we would then try to get his social security check from our son's death. Can I get in trouble having him here? He is safer and happier here. He is 16 and was still wetting the bed until he got here. He is happy and we all want him to stay. Please give us advise.

If First and foremost, you need to obtain either a guardianship or custody. There are advantages and disadvatages to both. You should contact an attorney to discuss your situation in more detail.

For now though, as long as mom consents you should be o.k. as things are/ However, there will be issues if emergany medical care is needed and if he is attending school in a district different than his mother.
