Legal Question in Family Law in Indiana

I was granted a divorce from same sex partner in july. I filed without involving our son since my partners name was not allowed on birth certificate. The law has since changed and the birth certificate has been amended. How do I go about filing for child support at this time, in Indiana? Thank you, Rachel

I am not sure that you can. Biologically the child is not your partner's. Since the child was not determined to be a child of the marriage, the divorce court has determined that the child is not your partner's. Since the name is not on the birth certificate, the certificate does not determine the child to be your partner's.

If you did the divorce with a lawyer, than you should talk to that lawyer to see if the decree could be vacated. If you did this on your own pro se, now you are painfully aware of the costs of do it yourself divorces.
