health insurance deductable

My husbands dicorce decree from his ex states that he carry health insurance on his little boy from that marriage. They have joint custody, with her holding primary residential custody. I work at a hospital and carry the insurance on the whole family since its better insurance, and makes sense to only pay one insurance premium. However, his ex wife always takes the boy to a only partial coverage hospital closer to her home. It's a 30 minute drive to the 100% coverage facility. This results in more expense. Without calling my husband to alert him, She took the child to the emergency room with the cost exceeding 3000$, and since they did not admit him, the insurance will not pay. Are we responsible for the bill if she did not tell my husband about this medical care needed until after the fact? How can we be held finanically accountable for decisions she makes alone??

You need to have an attorney review the decree in order to determine whether there may be a grounds for contempt or whether a modification needs to be considered.
