Legal Question in Family Law in Indiana

I'm helping my sister-in-law, Betty, with her divorce. Out of the blue, her husband told her he wanted a divorce after 22 years, left the house the same day, and was living with another woman within a few days. A few days later she found out he also had a long affair with their hired 30 yr old nanny of 10 years who is also one of Betty's best friends. They have a 16 yr old son that does not want to commit to which one he'll be living with but it's going to have to be with Betty probably 90% of the time.

Devastated, and with no money, she asked me to help her with the divorce.

A little more background, they file bankruptcy 3-4 years ago then again just recently started a chapter 13 bankruptcy or something like that. They live in a rental so there's no house to mess with. He makes about $60K per year plus he's due for a yearly bonus (appx $8K?) anytime now and she makes about $10K per year part time. They basically agree on everything but my problem is....

... Since there's no real alimony in Indiana and since the 16 yr old boy will probably be living with each one 50%, is there anyway to get him to have to pay anything???? He says he's going to give her $850.00 a month but is there anyway to put this in writing. The divorce papers I was filling out has a section on child support that I didn't quite know how to do. I want to get this $850 in writing or preferably more if possible, how do I do this???

Thanks!!!!!!!!!!!!!!!!

Mike

Mike:

This is far beyond what this forum can provide. It does sound like Betty might qualify for free legal services. I suggest that she contact the pro bono office that serves her county.
