who gets the home...

we have rented the house for 3yrs and he said the house is his and we have three children with each other he says i have to leave and he keeps the house during our divorce but his name is on the lease and mine isnt, but the lease hasnt been up to date since 2003...so do i have the right to stay in our home with my childre???

In a divorce proceeding, the court could allow you to stay in the home with the children until the court proceedings are finalized
